Minutes of the Cuyahoga County Planning Commission/Solid Waste Policy Committee

ATTENDANCE
Attachment A lists the attendance at this meeting, at which the following matters were discussed.

MINUTES
On a motion by Mayor Patton, seconded by Mr. Shannon, the minutes of the June 9, 2005 meeting were approved.

RESOLUTIONS
On a motion by Mayor Rawson, seconded by Mayor Kenneth Patton, Resolution No. 050811-A, a contract with the Cuyahoga County Department of Justice Affairs was unanimously approved.

On a motion by Mayor Rawson, seconded by Mayor Kenneth Patton, Resolution No. 050811-B, a contract with the Cuyahoga County Soil and Water Conservation District to complete the Lower Euclid Creek Watershed Planning Guide, was unanimously approved.

On a motion by Mayor Rawson, seconded by Mayor Kenneth Patton, Resolution No. 050811-C, an amendment to the Inter-Agency Agreement with the Cuyahoga County Department of Employment and Family Services to manage the Assessment and Evaluation contract, was unanimously approved.

On a motion by Mr. Shannon, seconded by Mayor Rawson, Resolution No. 050811-D, approving the nomination of Ms. Virginia Aveni to the Cuyahoga County Natural Resources Assistance Council, was unanimously approved.

On a motion by Commissioner Hagan, seconded by Mr. Shannon, Resolution No. 050811-E, recommending proposed changes to the Chagrin Falls Township Zoning Resolution, was approved. Mayor Rawson voted no.

In regards to Resolution No. 050811-F, Ms. Kris Hopkins stated that CPC staff is recommending approval of the resolution with twenty-four (24) conditions.

Mayor Blomquist stated that he would vote against this resolution due to his concern about the ability of the electric companies to provide enough power to Olmsted Falls and the current and new development taking place in the Township. He explained that Olmsted Falls' residents have been having power outages and he questioned whether the current electric infrastructure is has enough capacity to service both current and new development. Mayor Blomquist stated that he would maintain this position for all future resolutions until he sees a report explaining what the impacts are to the existing electric service.

Mr. Shannon asked whether the resolution could be amended to incorporate this issue.

Mr. Alsenas stated that the CPC could hold this item until the October meeting or amend the conditions to have the developer contact First Energy to get a review of whether there is sufficient capacity to serve this proposed development. Mr. Alsenas stated that the CPC will provide this information to the CPC before it has to act on the approval of the final plat.

On a motion by Mayor Blomquist, seconded by Mayor Rawson, Resolution No. 050811-F was amended to include a twenty-fifth condition that requires the developer to provide the necessary information on the status of the electrical supply system.

On a motion by Mr. Shannon, seconded by Mayor Blomquist, Resolution No. 050811-F was unanimously approved as amended.

COMMUNITY AND REGIONAL ISSUES
Patrick Holland, Director of the Cuyahoga County Solid Waste District, stated that the draft 5-year update of the Solid Waste Management Plan must be submitted to the Ohio Environmental Protection Agency (OEPA) by October 6, 2005.

Mr. Holland explained that the there was a number of key issues that would be presented today for input by Solid Waste Policy Committee.

The District's consultants provided an overview of the Strategic Planning process, the key issues and suggested strategies, and the impact of these issues on the District's Generation Fee.

Mr. Greenberg explained the six programs that were being recommended. He stated that implementing the six programs, continuing the District's current programs and making allowance for inflation would require an increase in the District's Generation Fee from $1.00 to $1.50 per ton. He stated that Generation Fee is based on the amount of waste that is generated which is approximately 2/3 from businesses and 1/3 from residential communities. A handout showing the increase per community was distributed to the Policy Committee members.

Mr. Greenberg stated that a decision on the Generation Fee increase was needed the Policy Committee so that the draft plan can be sent the OEPA and to each of the communities in Cuyahoga County.

After discussing the issue, Commissioner Dimora stated that the Board of Cuyahoga County Commissioners would pay for the $346,442 increase for the first year of the five-year plan, which would be 2007, to provide the District with enough time to educate the communities and to incorporate the increase into their budgets.

On a motion by Mayor Rawson, seconded by Mayor Blomquist, Resolution No. 050811-G, authorizing the Director to deliver the DRAFT Cuyahoga County Solid Waste Management Plan Update to the Director of the OEPA for review and non-binding advisory opinion prior to the initiation of the District-wide ratification process, was unanimously approved.

Mayor Rawson asked the District staff to explain how the new revenues will be divided between the six strategies, what the opportunities were for reinvesting the savings so that the Generation Fee would eventually decrease and how the Policy Committee could promote the new programs as a new way of doing business not just a fee increase.

PUBLIC COMMENT
Mr. Ed Hauser invited the CPC members to an event at Whiskey Island, expressed his continuing concern about Port Authority accountability and asked that the Cleveland Metroparks be allowed to maintain Whiskey Island.

Commissioner Dimora adjourned the meeting.
